Encroachments are anything not installed, constructed, or planted by the municipality within the Highway Right of Way. Examples include:

Many properties extend landscaping into the highway right of way. These encroachments add to the beauty of the Village’s streets and are welcome improvements.
However, when trees and shrubs become overgrown they can impact pedestrian and vehicle safety. Overgrown trees and shrubs become a hazard when they restrict a person’s view of vehicular or pedestrian traffic. To ensure safe sightlines:
Property owners are responsible for maintaining soft landscape encroachments adjacent to their property. If these encroachments are not maintained or become a sightline hazard, the Village may request their removal within 30 days of of a written request
Property owners wishing to install hard encroachments on the Highway Right of Way must first apply for a permit from the municipality, which will consider factors including but not limited to pedestrian access, sightlines especially at intersections, and future utilities (water, sewer, drainage, gas, electricity).
To obtain an Encroachment Agreement, a written application must include a professional drawing of the proposal. Work cannot proceed before a permit is issued, in most cases requiring approval by Council. Some encroachments require the homeowner to enter into a legal agreement with the Village of Lions Bay and the encroachment to be registered on the property’s legal title.
